Ms. Vivian de las Cuevas-Diaz is a Partner in the Miami office of Broad and Cassel. She is a member of the Firm’s Banking and Institutional Lending, Real Estate and Special Assets Practice Groups.

Ms. de las Cuevas-Diaz has extensive experience in complex real estate transactions, for both private and public clients. She also has vast experience in representing institutional lenders in commercial lending of various types of projects and developments in the United States. In addition, she has extensive experience in asset based loans secured by real estate, inventory, equipment receivables and securities.

Ms. de las Cuevas Diaz has had extensive experience in representing developers in the development of various projects including condominium, office and single family. She also handles the financing for such developments including institutional and mezzanine financing.

She has handled the preparation and negotiation of loan commitments, loan documents and dealt with related issues.

She has also represented clients in the purchase and sale of commercial and residential properties, development of commercial properties, commercial leasing and related transactions.

Ms. de las Cuevas-Diaz continues to focus more time working with institutional lenders guiding them toward resolutions for troubled loans and complex workouts. She is called on to assist clients in developing unique and innovative solutions forever increasing complex real estate transactions.

Ms. de las Cuevas-Diaz’s Special Assets experience and representative transactions include representation of lenders and developers nation wide with respect to forbearance, negotiation of loan modifications, restructuring and workouts on behalf of lenders and borrowers for various types of loans, deeds-in-lieu of foreclosure, note purchase and sales and foreclosures affecting numerous commercial properties located throughout the state and nation.

She was recently appointed by Florida’s U.S. Senators Bill Nelson and Marco Rubio to the Florida Judicial Nomination Commission (JNC).

Ms. de las Cuevas-Diaz is an active member of the community, and was recently elected as President-Elect of the Cuban American Bar Association. In addition to serving seven terms on the CABA Board of Directors, she has served as a member of the Enterprise Florida Board of Directors since 2007 and as Legislative Chair in 2009 and 2010. She is a member of the Latin Builders Association and serves on the Board of Directors for both the Kristi House and the American Red Cross. Her additional civic participation includes the Greater Miami Chamber of Commerce, the Builders Association of South Florida, the Florida Association of Women Lawyers, the National Association of Professional Women and Commercial Real Estate for Women (CREW).

Ms. de las Cuevas-Diaz has been a member of CABA throughout her legal career. Most notably, since 2005, she has had the honor of being part of the Board of Directors for CABA. While on the Board of CABA, she chaired most of the committees, including the Events, Membership, Legislative, Corporate Governance, Pro Bono, Art in the Tropics, Gala, San Carlos Diversity Symposium, and Mentor/Mentee & Scholarship committees. In addition, she also served as Treasurer and Vice President for the organization and currently serves as CABA’s President-Elect. While all of these roles have been fulfilling, founding the Art in the Tropics event, which has raised over $200,000.00 for CABA’s Pro Bono Project to support pro bono legal services in the community has been her greatest accomplishment.

Ms. de las Cuevas-Diaz is also fluent in Spanish.
